A citizen proposal seeks to raise the pension of retirees who keep contributing
The initiative, filed as a citizen proposal before the National Assembly and pending committee adoption in the Labor, Health and Social Development Committee, would amend Law 462 of 2025, the Social Security Fund organic law, so that the contributions of retirees who keep working are reflected in their pension, with retroactive effect.

Bill 197 entered the National Assembly in early October 2026 through the citizen participation channel and is recorded as referred to the Labor, Health and Social Development Committee. It is at the preliminary stage, pending committee adoption, the step by which a committee takes up the text to open the first debate. It is not sponsored by a deputy: it is a citizen proposal submitted to the National Directorate for the Promotion of Citizen Participation.
Its article 1 recognizes that a retiree who keeps paying contributions to the Social Security Fund after retirement is granted has the right to have those contributions increase the amount of their pension, and provides that this recognition takes effect retroactively and including the corresponding interest. Article 2 specifies that the law would add an article to Law 462 of 2025, the Social Security Fund organic law. Article 3 states that the rule would take effect the day after its enactment.
The measure targets pensioners who remain active in the labor market and keep contributing on their salary. If approved, those new contributions would no longer flow into the common fund without individual return and would instead recalculate the contributor's pension. The scale of the cost for the Social Security Fund would depend on how many retirees keep working and on the weight of the retroactivity and interest, which the text recognizes as a right but does not quantify or accompany with an actuarial study at this stage.
The effect is not immediate. The proposal must be adopted by committee and approved in three debates before becoming law, and its article 1 leaves the calculation of the increase to the application of the rule without setting a formula or a cap.
